Nebraska State Proposed Rules Rule 183 – 3rd Set

The Nebraska State Public Service Commission (Commission) is proposing to Amend Title 291, Chapter 9, Natural Gas and Pipeline Rules and Regulations to adopt rules regarding pipelines and to implement the provisions of the Major Oil Pipeline Siting Act. (See related article in the May 2012 edition of the DOT Pipeline Compliance News.) Based upon the comments received and the testimony offered from the June 18 hearing, the Commission has released the third set of proposed rules, which include:

  • the addition of a requirement that a map of the proposed route be filed,
  • that the intended contents of any pipeline be more thoroughly identified or that a Safety Data Sheet be provided; and,
  • a description of the method for state agencies and emergency response personnel to obtain updated Safety Data Sheets for any products in the pipeline in the event of incident.

Written comments regarding this third set of proposed rules may be filed no later than September 28, 2012 by 5:00 p.m. Interested parties should provide 1 original and 5 copies and send an electronic copy to angela.melton@nebraska.gov and rose.price@nebraska.gov.
